The website calivon.in (the "Site") is operated by Maan Enterprise ("CALIVON," "we," "us," or "our"), an Udyam-registered business operating the CALIVON brand, a registered trademark, with its registered address at 313820 Laxminagar Main Road Laxmi Nagar Chandreshnagar, trimurti tower, 360004 Rajkot GJ, India.

The Site provides an online platform for the sale of scrubs, lab coats, apparel, and accessories (collectively, the "Products") offered by us from time to time. CALIVON is powered by Shopify, which enables us to provide these services to you.

By accessing, browsing, or using the Site through any device, you ("you," "user," or "customer") acknowledge that you have read, understood, and agree to be bound by these Terms of Service, together with our Privacy Policy, Refund Policy, and any other policies referenced on the Site (collectively, the "Policies"), each of which may be updated from time to time.

All prices displayed are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Shipping charges, where applicable, are shown separately at checkout. Prices, discounts, and promotions are subject to change without notice and will not affect orders already confirmed.

We reserve the right to correct any pricing or descriptive errors, and to change, update, or discontinue any product listing at any time without prior notice.

Orders and Formation of a Contract

Placing an order constitutes an offer to purchase, subject to these Terms. You will receive an order confirmation by email and/or SMS acknowledging receipt of your order; this acknowledgment does not by itself constitute our acceptance. A binding contract of sale is formed only once your order has been dispatched.

We reserve the right to refuse, modify, or cancel any order that is incorrectly priced, inaccurately described, affected by a technical error, unavailable, or suspected of fraud or misuse of a promotional offer, provided the order has not already been dispatched. Where payment has already been processed for a cancelled order, the amount will be refunded to your original payment method.

We are not liable for any loss or inconvenience arising from order cancellations, pricing errors, or product unavailability, except as required by applicable law.

Payment

We accept payment through the methods made available at checkout, which may include credit/debit cards, UPI, net banking, and Cash on Delivery (COD) where offered. By providing payment information, you confirm that you are authorised to use the selected payment method.

In the event of a pricing error, we reserve the right to cancel the affected order and refund any amount already paid, even if the order was previously confirmed.

CALIVON is powered by Shopify. Sales made through the Site are made directly between you and CALIVON (Maan Enterprise); Shopify is not a party to that transaction and is not responsible for any aspect of it.

Availability of the Site and Force Majeure

We use reasonable efforts to keep the Site available and functioning, but do not guarantee that it will be uninterrupted, timely, or error-free. Access may occasionally be suspended for maintenance, technical issues, or reasons beyond our control.

We are not liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from events beyond our reasonable control, including natural disasters, strikes, courier or logistics disruptions, payment gateway outages, internet or telecommunications failures, cyberattacks, or government action ("Force Majeure Event"). Our obligations will be suspended for the duration of such an event, and we will resume normal operations as soon as reasonably practicable.

Disclaimer of Warranties

Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of India.

Any dispute, controversy, or claim arising out of or relating to these Terms, the Policies, or your use of the Site shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, as amended. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties, in the English language, with the seat and venue of arbitration at Rajkot, Gujarat, India.

Subject to the arbitration provisions above, the courts at Rajkot, Gujarat shall have exclusive jurisdiction over all matters arising out of or relating to these Terms, including the appointment of an arbitrator or enforcement of an arbitral award. We remain entitled to seek interim or injunctive relief from any court of competent jurisdiction to protect our intellectual property or confidential information, and such action shall not be considered a waiver of the agreement to arbitrate.

Miscellaneous

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

No failure or delay by us in exercising any right under these Terms shall operate as a waiver of that right. These Terms, together with our Policies, constitute the entire agreement between you and us regarding your use of the Site.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms without restriction, including in connection with a business transfer or restructuring.

The headings in these Terms are for convenience only and do not affect their interpretation.
